Terms and Conditions – Alushop

Skima BV is a company governed by Belgian law and responsible for all sales activities through the Alushop webshop.
2. Applicability
These general terms and conditions apply to all offers, orders and distance contracts between Alushop and its customers, both consumers and professional buyers. These conditions prevail over any terms of the customer, unless Alushop has expressly agreed otherwise in writing. By placing an order, the customer expressly accepts these conditions.
3. Offer and Orders
All offers on the website are non-binding and may be changed or withdrawn at any time. Product information is displayed as accurately as possible. Images and colour samples are indicative. For custom-made products (such as bent aluminium profiles, wall caps, roof edges, etc.), minor differences in colour or size may occur due to production processes. Orders are only valid after receipt of an order confirmation by e-mail. The customer must be at least 18 years old to order.
Alushop reserves the right to refuse or cancel an order in whole or in part in the following (non-exhaustive) cases: errors or inaccuracies in prices or product information, suspicion of misuse or fraud, delivery problems or unexpected unavailability of materials, late payment or incomplete customer data. In the event of cancellation by Alushop, any payment already received will be refunded without further compensation.
4. Prices
Prices on the website are shown in euros. The customer may choose whether prices are displayed including or excluding VAT, depending on the customer setting (consumer or professional). All prices include packaging but exclude delivery costs, unless stated otherwise. Discounts, promotions or offers are temporary and may be changed or ended without notice. Alushop reserves the right to adjust prices in the event of changes in raw material prices, transport costs or exchange rates. As long as the contract has not been concluded, prices and conditions may be adjusted. Obvious printing, typing or programming errors entitle Alushop to cancel the order without compensation.
5. Payment
Orders must always be paid in advance via the available payment modules (such as Bancontact, iDEAL, Visa, Mastercard, …). The order will only be processed after full payment. In the event of failed or refused payment, the order will be automatically cancelled. Alushop reserves the right, for business customers (B2B), to charge interest and flat-rate compensation in accordance with the Act of 2 August 2002 on combating late payment in commercial transactions.
6. Delivery
Deliveries are made to the ground floor of the address or collection point specified. The customer must ensure that the delivery location is easily accessible. If delivery is not possible due to local circumstances (inaccessibility, closure, insufficient space, …), an additional transport fee may be charged.
If delivery is delayed by more than 15 minutes due to the customer (e.g. waiting time for unloading or clearing space), Alushop reserves the right to charge €10 per started quarter hour.
Delivery times are indicative. Delay can never give rise to compensation or cancellation of the order. Custom-made products generally have a longer delivery time than stock products. Alushop is entitled to make partial deliveries. The risk of loss or damage transfers to the customer upon delivery.
7. Right of Withdrawal (Consumers)
Custom-made products: Products manufactured according to the customer’s specifications or clearly personalized (such as custom aluminium, bent profiles, roof edges, wall caps, etc.) are excluded from the right of withdrawal in accordance with Article VI.53, 3° of the Belgian Code of Economic Law. These orders cannot be cancelled or returned, as production begins immediately after ordering.
Standard products: For standard products (such as fasteners, maintenance products or accessories), the statutory right of withdrawal of 14 calendar days after receipt applies. The customer must notify Alushop in writing via e-mail (hello@alushop.be) within this period. The goods must be returned unused, in their original packaging and at the customer’s expense. After receipt and inspection, the purchase amount will be refunded within 7 days.
8. Cancellation
For custom-made products, cancellation after ordering is not possible, as production and material procurement start immediately.
For standard products, cancellation is only possible if the order has not yet been processed or shipped. In case of cancellation at the customer’s request after processing, Alushop reserves the right to charge the actual costs incurred or 30% of the order amount as a flat-rate compensation.
9. Warranty and Conformity
Alushop supplies its products in accordance with the agreed specifications and the usual quality standards within the sector. Alushop’s obligations are limited to what is expressly provided in these terms and conditions. No obligation of result or additional warranty arises beyond what is stated herein. The customer must report any visible defect immediately upon delivery and any hidden defect in writing within eight days of discovery, under penalty of forfeiture of any right to intervention or compensation. A complaint does not suspend the customer’s payment obligation.
If a complaint is made in due time and found to be justified, Alushop shall, at its discretion, decide to:
- repair or replace the product, or
- refund all or part of the amount paid.
Repair or replacement may only take place after prior written approval by Alushop. Each intervention is limited to the product concerned; additional costs or damages are not compensated. Repair or replacement does not extend or renew the original warranty period.
The warranty applies only to manufacturing or material defects demonstrably attributable to Alushop. It does not apply to:
- normal wear and tear or ageing of materials;
- slight deviations in colour, gloss, texture or dimension that are technically unavoidable or fall within usual tolerances;
- damage caused by incorrect assembly, improper use, lack of maintenance, incorrect storage or alteration of the product;
- damage resulting from weather influences, pollution, chemical attack, mechanical stress or transport after delivery;
- defects arising from the use of non-original or non-approved parts.
Alushop’s liability is in all cases limited to the value of the product concerned. Alushop is not liable for indirect damage, consequential loss, loss of profit, loss of customers or any other economic or immaterial loss. Any liability for minor fault or negligence is excluded. Only in the event of intent or gross negligence by Alushop may a right to compensation arise, and only for direct damage resulting directly from the proven defect.
Where the customer acts as a consumer within the meaning of the Code of Economic Law, they have the statutory two-year conformity guarantee, applying only to defects in the product that already existed at the time of delivery. This guarantee covers only the repair or replacement of the defective product, at Alushop’s choice, within a reasonable time and free of charge to the consumer, unless impossible or disproportionate. The consumer must notify any defect in writing within two months after discovery. Defects resulting from incorrect use, assembly, maintenance or external factors are excluded from this guarantee.
10. Liability
Alushop’s liability is limited to the obligations stated under the warranty. Alushop cannot be held liable for damage resulting from incorrect assembly, improper use, incorrect application or failure to follow installation instructions. Alushop is not liable for indirect, consequential, profit or immaterial loss. Alushop’s total liability is always limited to the amount of the relevant invoice.
11. Retention of Title
All goods delivered remain the property of Alushop until full payment of the sales price, including any costs and interest. The risk of loss or damage transfers to the customer upon delivery.
12. Force Majeure
In the event of force majeure (such as strikes, fire, operational disruptions, power failures, pandemics, government measures, import restrictions or communication failures), Alushop is not obliged to fulfil its obligations. The obligations may be suspended for the duration of the force majeure or the agreement may be dissolved without compensation.
13. Intellectual Property
All content on Alushop (texts, images, logos, technical drawings, etc.) is protected by intellectual property rights. Use, reproduction or distribution without prior written consent of Alushop is prohibited.
14. Complaints and Disputes
Complaints may be submitted via hello@alushop.be. Alushop aims to respond within 5 working days. For professional customers, a complaint period of 2 working days after delivery applies. All agreements are governed by Belgian law. Only the Dutch-speaking courts of the judicial district of Brussels are competent. Consumers may also contact the European ODR platform: http://ec.europa.eu/consumers/odr.
15. Nullity and Severability
The nullity or invalidity of any provision of these terms does not affect the validity of the remaining provisions. In that case, the invalid clause shall be replaced by a valid clause with as similar effect as possible.

Alushop processes personal data in accordance with the GDPR. Please refer to the privacy statement on the website for more information.
17. Amendments
Alushop reserves the right to amend these terms and conditions. The most current version is always available at www.alushop.be.
